18 U.S.C. § 1030(a)(2)(C) — Unauthorized Data Access
This is the most common provision applied to unauthorized network probing. It states that whoever:
“…intentionally accesses a computer without authorization or exceeds authorized access, and thereby obtains… information from any protected computer”
Shall be punished as provided in subsection (c) of this section. Because almost any computer connected to the internet is legally defined as a “protected computer,” gathering banner information or service details from an unauthorized port scan fits this description.
18 U.S.C. § 1030(a)(5)(A), (B), and (C) — Causing Damage
If a port scan is run too aggressively and crashes a website or floods its bandwidth, it triggers the damage provisions:
- (5)(A): Knowingly causing the transmission of a program, information, code, or command, and as a result, intentionally causing damage without authorization.
- (5)(B): Intentionally accessing a protected computer without authorization, and recklessly causing damage.
- (5)(C): Intentionally accessing a protected computer without authorization, and as a result, causing damage and loss.
